Bilateral (direct) contracts are an over-the-counter segment where pricing is based on a bilateral agreement between the parties. They allow the parties to protect themselves from price risks and possible shortages. The participants in the bilateral contracts market are producers, electricity suppliers, the transmission system operator - Ukrenergo, the distribution system operator, traders, a guaranteed buyer and consumers. The participants in the bilateral contracts market are free to choose counterparties, conclude contracts in any form and by agreement of the parties. An essential condition of a bilateral contract should be liability for imbalance in the event of non-performance of the contract. A mandatory requirement for the performance of such a contract is its registration in the system of the transmission system operator - Market Management System (MMS). The parties to bilateral contracts must register the relevant hourly volumes of electricity each trading day. The gate for registration closes at 11:00 D-1 (one day before the trading day). The procedure for concluding a bilateral agreement with LLC «ENERGY INVESTMENT GROUP»: 1. Get acquainted with the terms of the electricity purchase and sale agreement. 2. Decide on the main terms of cooperation: the desired volume of electricity, type of load, duration of cooperation; 3. Any business entity that has received a license to produce electricity. Energy supplier - sells electricity under an electricity supply agreement to a consumer. Any business entity that has received a license to supply electricity to a consumer. Trader – purchases electricity exclusively for the purpose of resale, except for sales under an electricity supply contract to a consumer. Any business entity that has received a license for the resale of electricity (trading activity). Transmission system operator (TSO) – is responsible for the operation, dispatching, maintenance, and development of the transmission system and interstate power transmission lines. The functions of the TSO are performed by NEC “Ukrenergo” in accordance with the license for the transmission of electricity. Distribution system operator (DSO) – is responsible for the safe, reliable, and efficient operation, maintenance, and development of the distribution system. The functions of the DSO are performed by the relevant regional energy authorities in accordance with the license for the distribution of electricity. Market operator – ensures the functioning of the day-ahead and intraday markets and organizes the purchase and sale of electricity on these markets. The newly created enterprise of the State Enterprise “Market Operator”. Guaranteed buyer – purchases electricity from producers who have a “green” tariff set. The newly created enterprise of the State Enterprise “Guaranteed Buyer”. The consumer – purchases electricity for his own consumption.
